On May 21, The Committee of 100 on the Federal City filed its Consolidated Reply, responding to the briefs of CSX and the Federal and District Defendant that opposed our Emergency Motion. Our Emergency Motion sought reconsideration based on: (1) information contained in the Administrative Record that was not available to the C!00 when we sought the Preliminary Injunction and was not available to the District Judge when he denied our request for the Preliminary Injunction, and, (2) the application of an overly restrictive legal standard by the District Court as to what constitutes predetermination in a NEPA proceeding. - C100 Supplemented Motion And Memorandum Of Points And Authorities

On May 13, 2015, the Committee of 100 filed a Supplemented Motion, asking the District Court to issue a preliminary injunction that would effectively stop the Virginia Avenue Tunnel expansion project from proceeding until a decision on the merits of the Committee's lawsuit is issued.
